Information Technology and Intellectual Property Law

The Department of Information Technology and Intellectual Property Law (ICT-KI), formerly known as the Law and Technology Specialization Program, is part of the Faculty of Law, Padjadjaran University (FH Unpad), and was established in 2009. In 2012, this program transformed into the ICT-KI Law Department to respond to the rapid developments in the fields of Information and Communication Technology and Intellectual Property.

Its origins stem from the involvement of FH Unpad and the Bandung Institute of Technology (ITB) in the drafting of the Electronic Information and Transactions Law (UU ITE) since 2000, which was finally passed into law in 2008. This ITE Law became the first law in the field of cyberlaw in Indonesia. Since then, cyber law studies in Indonesia have grown rapidly, followed by other areas of study such as e-commerce, cybercrime, intellectual property rights (IPR) in cyberspace, and the protection of privacy and personal data.

Along with advances in digital technology, digital transformation, and the emergence of new technologies such as blockchain, the Internet of Things (IoT), and artificial intelligence (AI), the ICT-KI Law Department continues to evolve to address emerging legal challenges. Furthermore, the Intellectual Property (IP) aspect has also experienced significant development, particularly in the areas of geographical indications, traditional cultural expressions, patents, and digital copyright. With the rapid pace of digitalization, the protection of digital intellectual property rights, including digital rights management (DRM), digital licensing, and copyright infringement in cyberspace, has become a primary focus of research and teaching in this department.

The ICT-KI Law Department is committed to continuously adapting to technological and legal developments to produce academic studies and regulations that address the challenges of the digital era.

The Department of Information Technology and Intellectual Property Law (TIK-KI) actively organizes various academic, research, and community service activities involving students from undergraduate, graduate, and doctoral study programs. These activities aim to develop understanding and insight in the fields of Information and Communication Technology (ICT) and Intellectual Property (IP) Law, while also addressing legal challenges arising from the development of digital technology.

In addition, the Department of Information Technology and Intellectual Property Law actively and continuously holds various scientific activities such as public lectures, seminars, webinars, and Focus Group Discussions (FGDs) featuring experts from various backgrounds. This activity is not only aimed at academics, but also involves legal practitioners, industry players, and policymakers to enrich discussions and analyses in the fields of cyber law and intellectual property.

Lecturers in the ICT-KI Law Department also frequently serve as resource persons in various activities organized by Ministries, Government Agencies, and the business and industrial sectors. This involvement includes legal consultations related to regulations in the field of ICT and IPR, the development of personal data protection policies, internet governance, e-commerce law, and the protection of intellectual property rights in the digital era. With these contributions, the ICT-KI Law Department plays an active role in shaping policies and regulations that adapt to technological developments and global dynamics in the field of cyber law and intellectual property.

Contribution of ICT-KI Lecturers to National Regulations

Lecturers in the Department of Law, ICT-KI, Faculty of Law, Unpad, are not only involved in academic studies but also frequently serve as resource persons in various government forums, both at Ministries/Institutions and in discussions with relevant stakeholders. This involvement includes:

  • Providing academic input in the formation of legal policies based on scientific research.
  • Serving as an expert and assistance team member in drafting bills in various ministries, such as the Ministry of Communication and Information (Kominfo), the Ministry of Law and Human Rights (Kemenkumham), the Financial Services Authority (OJK), and the Coordinating Ministry for Political, Legal, and Security Affairs (Kemenkopolhukam).
  • Participating in Focus Group Discussions (FGDs) and public consultations to harmonize regulations at the national and international levels.

The bills that are the focus of the ICT-KI Legal Department's contribution include:

  1. Intellectual Property (IPR)
    • Copyright Bill → Drafting regulations to protect copyright in the digital era, including digital rights management and copyright ownership of digital content.
    • Trademark Bill → Strengthening regulations related to trademark protection at the national and international levels.
    • Patent Bill → Updating and harmonizing patent law to support domestic innovation and research.
    • Geographical Indications Bill → Developing regulations that protect local products with specific geographic characteristics to strengthen the creative economy and regional specialty products.
  2. Information and Cyber ​​Technology
    • Information and Transactions Bill Electronic Information and Communications (ITE) → The ICT-KI Legal Department, together with the Bandung Institute of Technology (ITB), participated in the formulation of the ITE Law, which is the first legal basis for cyber law in Indonesia and has become a reference in the regulation of electronic transactions.
    • Convergence Bill → Regulates the development of increasingly integrated communication technology, including digital broadcasting and internet-based services.
    • Telecommunications Bill → Adapts telecommunications regulations to developments in digital technology, including 5G networks and cloud-based communication infrastructure.
    • Cybersecurity and Resilience Bill → Develops regulations to strengthen national cyber resilience and protect against the threat of cybercrime, digital attacks, and the security of critical information technology-based infrastructure.
  3. Data Protection and Transparency Information
    • Personal Data Protection (PDP) Bill → The ICT-KI Legal Department plays a role in academic studies and provides input for the formation of the Personal Data Protection Law, which is now the main basis for data management in the digital era and data-driven economy.
    • Public Information Disclosure Bill → Drafting regulations regarding the public's right to obtain information from public bodies in a transparent and accountable manner.
  4. Financial Law and Anti-Financial Crime
    • Money Laundering (TPPU) Bill → ICT-KI lecturers participate in drafting regulations to strengthen the prevention and enforcement system for money laundering and digital-based financial crimes.
