Transnational Business Law

The Department of Transnational Business Law was established based on the Decree of the Rector of Padjadjaran University Number 189/ UN6.RKT/Kep/HK/2019 concerning the Establishment of the Department of Transnational Business Law, Faculty of Law, Padjadjaran University. This department was established on the initiative of the Dean of the Faculty of Law, Padjadjaran University for the 2015-2020 Period, Prof. Dr. An An Chandrawulan, S.H., LL,M. as a contribution of the Faculty of Law, Padjadjaran University to respond to the development of the globalization era, especially in the field of Transnational Business Law. In its current development, the Department of Transnational Business Law partners with several ministries/institutions and other bodies with the penthahelix concept. The Department of Transnational Business Law fosters the Transnational Business Law Specialization Program interest which began to be provided for students entering the 2016 intake. In 2020, the Department of Transnational Business Law initiated the formation of the Transnational Business Law Student Association or known as the Association Transnational Business Law Students (ATBLS).

General Overview

  1. Transnational business transactions have experienced significant growth in various countries, including Indonesia. This development has been driven by government policies in engaging in regional and multilateral trade.
  2. Regionally, the government has participated in regional cooperation with the Association of Southeast Asian Nations (ASEAN). Within ASEAN, the leaders of the ten ASEAN member countries have agreed to a significant agreement, namely the establishment of the ASEAN common market by 2015.
  3. Multilaterally, the government has long participated in the multilateral agreement, the General Agreement on Tariffs and Trade (GATT) in 1950. The government has also committed to global trade liberalization when the GATT was replaced by the World Trade Organization (WTO) in 1994.
  4. These various regional and multilateral trade agreements have direct implications for trade transactions. Regional and multilateral agreements have provided opportunities for businesses (domestic and international) to conduct cross-border transactions directly between member countries.
  5. This rapid growth in transactions has also had implications for legal developments. These cross-border transactions give rise to rights and obligations formulated in legal regulations between the parties or business actors. This development is evident, among other things, in the legal regulations agreed upon by the parties, which are outlined in, among other things, commercial transaction contracts between business actors.
  6. This development in the legal field encourages understanding and study of the legal aspects arising from these various agreements or emerging transactions. However, in facing these developments, law faculties, particularly at Padjadjaran University, do not yet have an institution or department specifically studying and anticipating legal developments arising from these various international business transactions.
  7. In this development, the state plays a role not only as Jure Imperii but also as Jure Gestiones, particularly in the development of Transnational Business Law.
  8. Based on the above considerations, it is deemed necessary and timely to establish a special department, namely the Department of Transnational Business Law, to study and research developments arising from these various cross-border business transactions.

Goals

  1. To examine legal developments and their issues in the practice of transnational business transactions.
  2. To prepare prospective law graduates who are ready to face the developments and needs of legal practice in transnational business transactions. From a scientific perspective, an understanding of legal developments arising from and evolving from international business transactions makes an important contribution to legal science.
  3. The establishment of this department is also in line with the Vision and Mission of the Faculty of Law, Padjadjaran University, namely to make the Faculty of Law and its graduates a leading faculty on a global scale (world-class).

Objectives

  1. Understanding legal developments and legal issues in transnational business transaction practices.
  2. Preparing Unpad Faculty of Law graduates to play a role in the workforce in the field of transnational business transaction law.
  3. Developing knowledge of transnational business transaction law at Unpad Faculty of Law.
  4. Making Unpad Faculty of Law superior regionally and globally (world-class).
